A former Trump campaign official who is now one of the former president’s 14 remaining co-defendants in the Georgia election racketeering case accused the district attorney leading the prosecution of an "improper" relationship with an outside attorney she made special counsel for the case.

The allegations leveled at Fulton County District Attorney Fani Willis and special counsel Nathan Wade were made by attorneys for the former campaign aide Michael Roman without evidence beyond citing “discussions with individuals with knowledge” that go unnamed in a court filing introduced Monday.

The filing by Roman’s lawyer Ashleigh Merchant, a longtime Georgia criminal defense attorney, makes the case that the prosecution is unconstitutional on two merits: Willis never had the authority to appoint Wade as special counsel and that the pair engaged in a “improper, clandestine personal relationship” that Wade profited from to the tune of at least $650,000 as of last month.

Roman faces a racketeering charge, two counts of making false statements to investigators, one account of impersonating a public officer, two counts of forgery and one count of filing false documents. He was one of the 18 original co-defendants charged alongside Trump, but four have since pleaded guilty. On Tuesday, he used the news of the court filing to promote a fundraiser for his legal bills on X, the social media platform formerly known as Twitter.

“The district attorney and the special prosecutor have violated laws regulating the use of public monies, suffer from irreparable conflicts of interest, and have violated their oaths of office under the Georgia Rules of Professional Conduct and should be disqualified from prosecuting this matter,” Merchant wrote.

On Monday night, former President Donald Trump, who Willis leveled 13 felony criminal charges against, shared large chunks of text of an Atlanta Journal-Constitution article about the allegations on social media. He called for all charges against himself and his co-defendants to be immediately dropped, accompanied by apologies and monetary damages to the defendants while also baselessly accusing President Joe Biden of being involved in the case.

The 2024 GOP presidential primary frontrunner’s legal team argued in a separate court filing on Monday that he was immune from the Georgia prosecution due to the powers imbued in the office of the presidency. It’s an argument another portion of his legal team is making in Washington this week to an appeals court in the federal election interference case. 

Trump has frequently targeted his ire at Willis, as he has with many judges and prosecutors assigned to his four criminal cases and multiple civil trials. His campaign has run ads previously accusing her of a romantic relationship with a gang member she was prosecuting and sent an email focusing on Willis’ pride in her Black heritage and her father’s role in the Black Panthers. 

In Roman’s filing, Merchant wrote she has no knowledge of Willis receiving approval to appoint a special prosecutor from Fulton County’s government, a requirement Merchant says is necessary by law. The filing cites open records requests for documentation of approval, but Merchant writes she did not receive any and says a Fulton County commissioner told her approval was never granted.

Without evidence, Merchant also accuses Wade of being Willis’ “romantic partner,” citing Wade’s divorce and unshared evidence of trips the pair took together. The filing is also rife with unbacked rumors Merchant claims to have heard.

“Sources close to both the special prosecutor and the district attorney have confirmed they had an ongoing, personal relationship during the pendency of the special prosecutor’s divorce proceedings,” Merchant wrote. 

Merchant told NBC News that she will present “concrete evidence” at the next hearing and said it would possibly involve Willis and Wade testifying. She also said she asked a Cobb County, Ga., judge to unseal Wade’s divorce records.

Roman is accused of participating in the fake elector scheme, working with Trump’s allies to send fake Electoral College votes in Trump’s favor to Congress to place Georgia in the then-president’s column. Biden won Georgia narrowly, by roughly 11,000 votes out of nearly five million ballots cast.
