The State Assembly’s Judiciary Committee is not making any recommendation about the residency status of incoming Assembly member Lester Chang. Assembly Democrats had threatened to block him from serving over whether or not he lives in Brooklyn. But the report offers no roadmap on what to do.
Chang, a Republican, beat Democratic incumbent Peter Abbate in Brooklyn’s 49th Assembly District in November. But after the race was decided, questions were raised by Democrats about whether Chang lived in Brooklyn or an apartment he rents in Manhattan. By law, Chang must live in the borough of Brooklyn for a full year prior to Election Day.
Assembly Speaker Carl Heastie asked the Assembly Judiciary Committee to investigate the residency issue, and prepare a report before the end of the year. The 150-page report offers details about Chang’s residency status that raise questions about whether Chang can legally serve, but stops short of saying he can’t.
The report will be forwarded to the new Assembly which will convene next week for the first time, and members will make a decision about whether Chang will be seated.
