NEW YORK — NY1 has exclusively learned that U.S. Immigration and Customs Enforcement (ICE) has released an undocumented immigrant arrested after President Joe Biden took office, even though he doesn’t meet Biden’s priorities for deportation.

Alonso Castillo surprised his live-in girlfriend and business partner at their Long Island bagel shop on Friday. One of his three children videotaped the reunion. All of his kids were born in the United States, so they’re American citizens.

An appeals judge ruled the Queens resident does have credible fear of being returned to Mexico, and ICE granted Make The Road New York’s request for his release, which was based in part on his health issues and COVID-19 in the jail.

His asylum application is centered around concerns that gangs, which have assaulted him before, will attack him again in Mexico.

His case is now pending. Due to COVID-19-related court delays, it could be years before it’s resolved.
