Charleston, S.C. — Attorneys for Dylann Roof, the man charged for killing nine African American’s attending bible study at Mother Emanuel AME Church in 2015, have filed a new motion.

The filing claims Roof had a disorder that hindered him to represent himself. His legal counsel now believes that the action violated Roof's rights.

According to court documents, Roof’s attorneys are looking to change his conviction and sentence, alleging that the trial court violated Roof’s Fifth and Sixth Amendment rights.

The motion also alleges that the U.S. District Judge assigned to the case did not remain unbiased.

“Judge Gergel presiding over Dylann’s case because he ‘really want to’ violated Dylann’s Due Process right to an impartial procedure for assigning a judge, and trial counsel’s failure to object violated Dylann’s Sixth Amendment right to effective assistance of counsel” the document reads.

Roof is currently being held while on death row at Terre Haute Federal Prison in Indiana.
