There’s a battle brewing over discovery law in New York. A legal term, discovery broadly pertains to how quickly prosecutors must share evidence with defense lawyers in a criminal case.

The current law — put in place in 2019 — demands prosecutors present all “related” evidence to the case or risk having it dismissed.

Now, prosecutors argue the standard should be changed to “relevant” evidence — giving judges more leeway in deciding when to dismiss a case if evidence is not presented in time.

Prosecutors, alongside Gov. Kathy Hochul, argue case dismissals have spiked in New York because of the current discovery law, but defense lawyers and state lawmakers disagree.

Queens District Attorney Melinda Katz joined “Inside City Hall” Tuesday to discuss why she believes discovery needs to be changed.
