A construction worker died after a floor collapsed inside of a building under construction in Brooklyn Friday, police said.

The incident occurred around 12:22 p.m., when the first floor of a two-story residential building located at 1266 50th St., near 13th Avenue in Borough Park, collapsed into the basement, killing a 33-year-old Juan Tamay, the NYPD said. 

Tamay’s grieving family stood outside the construction site in Borough Park, barely able to speak about their pain.

“He was a good man, he worked for our family, he tried to protect us,” said Juan Tamay’s son William.

Tamay was working in the basement at the time, and got pinned under the rubble.

“The floor collapsed in a v-shape, which means the middle of the floor collapsed and came down on top of the victim,” said Joseph Ferrante of the FDNY. “We’re not sure what caused it. There was construction material on the floor at the time of the collapse.”

“This fatality absolutely should not have happened,” said Department of Buildings Commissioner James Oddo.

Oddo said the agency visited the two-story site in December after complaints were filed, but was unable to access the site. On Jan. 4, the city issued a stop-work order. Additionally, Oddo said the agency had no permits on file.

“The only work that should have been done at this site was to make this site safe. As you can see, the stop-work order was violated. There are absolutely no plans submitted to the Department of Buildings,” Oddo said.

Tamay leaves behind two children, with a third on the way. The family said they want justice for his tragic death.

“I wanna help my nephew please because he has two children and a wife,” said Juan Tamay’s aunt Escolastico Tamay.

“Please help me investigate his case because where he worked, he said he did not have permission to work,” said Juan Tamay’s wife, who did not wish to be named.

The city said there’s no structural damage to the adjacent buildings. Oddo said fines may amount to thousands of dollars, but it’s unclear if any charges will be filed.
