Republican Claudia Tenney is declaring victory in the race for New York's 22nd Congressional District, but Democratic incumbent Anthony Brindisi said the count isn't over yet.
The two have been in a court battle for months, arguing over discrepancies with ballots.
A judge ordered seven of the eight counties in the district to certify results by Tuesday. Oneida County, however, was ordered to hold off until a court hearing on Friday.
Based on the latest unofficial counts, Tenney said she's won by just 123 votes.
Her campaign released a statement, saying "court proceedings in the race began more than 90 days ago, and Claudia Tenney has led in the vote count every step of the way. The court's review has been thorough, transparent, and fair to all parties. Ballots have been scrutinized and we are confident all legal votes have been counted."
Brindisi's campaign believes he will come out on top when all is said and done, saying "the voters of New York's congressional district decide who represents them, not Claudia Tenney. With a margin between the two candidates of less than .04%, the courts must make sure the voters of New York’s 22nd Congressional District receive a complete and fair counting of all lawful votes."
