Advocates are calling on Gov. Kathy Hochul to sign the Grieving Families Act before the holidays.

It would change the list of eligible people who can file a wrongful death lawsuit on behalf of loved ones. Currently, only spouses, domestic partners, and parents or legal guardians of minors are eligible.

Under the law, that would be expanded to a parent or grandparent of an adult who does not have a spouse or child.

The Grieving Families Act would allow family members to be compensated for emotional loss.

The law would extend the statute of limitations to claim wrongful death to three years after death. The bill was well received by both parties in Albany.

Hochul vetoed an earlier version of the law twice, saying it could have “unintended consequences on healthcare companies and on businesses.” Hochul’s office released a statement saying she will “review the legislation”.

Jose Marrero, an advocate for the bill, says his wife died during a routine procedure at Maimonides Medical Center last year.

Marrero and attorney Christopher Donadio joined “The Rush Hour” on Wednesday to discuss the legislation.
