Daniel Penny, the Marine veteran charged in the subway chokehold death of Jordan Neely, was in court Thursday for a pretrial hearing.

The hearing was to sort out what evidence will be presented at the trial.

Penny is charged with second-degree manslaughter and criminally negligent homicide.
