Three people were indicted Thursday, in connection to the overdose death of a toddler at a Bronx day care.

Officials said several other children were also sickened after they were exposed to opioids.

Day care operator Grei Mendez, 36, her husband, Felix Herrera Garcia, 34, and his cousin Carlisto Acevedo Brito, 41, all pleaded not guilty to murder. They’re all accused of running a drug lab out of the Divino Ninos day care center in the Bronx, officials say.

“This was a drug operation,” said Bronx District Attorney Darcel Clark. “And they used babies as a shield to run their operation.”

The facility was at the Kingsbridge Heights Community Center on Morris Avenue in Fordham.

Nicholas Dominici, a 22-month-old, died and his death was ruled a homicide. Dominici’s father, Otoneil Feliz, spoke about the tragedy during a press conference Thursday.

“She was lying every single day,” said Feliz.

Prosecutors said three other children, between eight months to two years old, were also exposed to fentanyl but survived.

Police said the three suspects conspired to distribute fentanyl at the day care where large quantities of the opioids were stored near areas where children played and slept.

“Taking the life of the kids — a risk — use for make money on this way,” Feliz said. “I can’t imagine that.”

Court documents allege Garcia, who was arrested in Mexico after a nearly two-week manhunt, received a call from Mendez before she called 911. The documents report the call was after the children began showing symptoms of opioid exposure.

Security footage shows Herrera Gacria entered the building before emergency responders arrived, then left with two full shopping bags. Prosecutors said Mendez then deleted more than 20,000 text message between her and her husband.

“EMS who recognize although they were small children, recognized immediately that these children had some sort of opioid exposure and immediately took action and gave them Narcan, saving their lives,” said NYPD Chief of Detectives Joseph Kenny.

Bronx DA Clark said her office will be scrutinizing all home-based daycares in the Bronx after the tragedy. The city and state have both announced deeper oversight.

“To make sure I can also make recommendations to the city as to how this can be done,” Clark said. “If we can continue to have home daycare centers and if so, how should they be regulated so we can make sure that we never have another death again.”

The charges announced Thursday are separate from a federal case.

The three suspects and a fourth suspect are also facing federal drug charges.
