Daniel Penny, the former Marine facing second-degree manslaughter charges in the death of Jordan Neely, has spoken out on camera for the first time since the incident.
In a video released by his attorneys, Penny says he jumped on the F train after class on May 1 and noticed Neely's erratic behavior immediately.
"The three main threats he repeated over and over was 'I'm going to kill you,' 'I'm prepared to go to jail for life' and 'I'm willing to die,'" Penny said in the video.
In the pre-recorded video, Penny claimed 30-year-old Neely posed a threat to his fellow passengers.
"I had to act and I acted in a way that would protect the other passengers, protect myself and protect Mr. Neely," Penny said.
Penny is expected to appear in court July 17.
NY1 reached out and asked to interview Penny, but his attorneys denied the request. NY1 also reached out to the Neely family for comment, but has not received a response as of Monday afternoon.
