KINGSTON, N.Y. -- “Trust your heart and follow it. You will find happiness at last.”
That was part of a letter a state police investigator read in court Monday, which was written to urge Linda Kolman to take back Gilberto Nunez. The investigator told the prosecution Nunez admitted he sent Linda the letter, pretending to be his own mother.
Nunez is charged with second degree murder. Prosecutors say he killed Thomas Kolman by giving him a sedative called midazolam, because he was having an affair with Linda.
The prosecution also called State Police Investigator John Gallo to the stand. Gallo testified that 2,072 deleted text messages from September 14, 2011 to February 15, 2012 were recovered from Nunez’s phone.
But on cross examination, Gallo read some of the recovered text messages between Nunez and Kolman the day before Kolman died. They turned out to be about a football game. Gallo also said that, sometimes, texts can be deleted automatically by the phone.
The prosecution also called State Police Sr. Investigator Jeffrey Ullman. Ullman talked about the investigation of Kolman's car where he was found dead in a Planet Fitness parking lot in the Town of Ulster. But under cross examination, the investigator said Nunez's fingerprints were not found in the car.
Earlier in the day, the prosecution also showed photos of Nunez's dental office and apartment.
The prosecution ended the day playing a police interview conducted by Detective Michael Thomas. His testimony continues Tuesday.
