The House committee investigating the Jan. 6, 2021 attack on the Capitol unanimously voted Thursday to subpoena former President Donald Trump for documents and testimony.
Dan Goldman, a former lead counsel in Trump’s first impeachment trial and the Democratic nominee for New York City congressional seat, joined Errol Louis on “Inside City Hall” Friday to discuss what is expected to come next.
“The potentially surprising aspect was that they brought it to a vote,” he said. “This had been in the discussion for months now and I think ultimately what they realize and what they decided is this is an investigation in part for historical record.”
Goldman said Trump was “so clearly at the center” of everything that happened leading up to the attacks and the day of an insurrection. He added that Trump has “incredibly relevant information.”
“As the committee investigating that episode and the effort to overturn the election, it was incumbent on them to seek his testimony,” Goldman said.
When asked if Trump would show up to testify, he said there’s no expectation from anyone that Trump would comply with the subpoena.
“And what it just shows is just the degree to which he has transformed the discourse and lowered expectations for someone of his stature in our country that no one expects him to abide by the law because he never does abide by the law,” Goldman said.
According to Goldman on what he’s seen so far, there’s a potential on Trump and others around him to “be charged with seditious conspiracy.”
“There’s the possibility of him being charged with obstructing the Congress’s counting of the votes. But I think the most appropriate charge would be to charge him with the conspiracy to overturn the election,” he added.
On “Inside City Hall” in September 2021, former New York City mayor and Trump advisor Rudy Giuliani said that there were good faith reasons to doubt the elections being done fairly. Goldman dismissed the assertion when asked by Errol.
“There is no good faith basis to believe anything that Rudy Giuliani is saying.”
