BINGHAMTON, N.Y. -- A captain at the Broome County Sheriff's Office is currently under investigation. 

Otsego County District Attorney John Muehl has been appointed by a supreme court judge to look into an incident involving captain Kate Newcomb.

The case in question happened in 2009 in relation to a DWI arrest.

This investigation was requested by Broome County District Attorney Steve Cornwell to determine whether there was any wrong doing on Newcomb's part during that arrest.

Newcomb's boyfriend is State Sen. Fred Akshar, but District attorney Muehl says he is not being investigated.
