Closing arguments are expected to begin Monday in the Daniel Penny trial. Penny is a 26-year-old Marine veteran charged with manslaughter and negligent homicide for the death of Jordan Neely last year.

Prosecutors say Penny applied a deadly chokehold on Neely causing his death. Penny’s attorneys argue he was not trying to kill Neely but restrain him after witnesses said Neely was acting erratically in a subway car.

Neely was 30 years old and sometimes entertained subway riders as a Michael Jackson impersonator. He also had a history of psychiatric and drug problems and a criminal record.

Former Brooklyn Assistant District Attorney Bernarda Villalona joined anchor Rocco Vertuccio on “Weekends on 1” Sunday to discuss the trial.
