“It looks to me that there may be a not guilty by reason of insanity defense that they’re going to be thinking about,” Agnifilo said, while appearing as a commentator on CNN before being retained as Mangione’s counsel.
“I don’t know that he would have any chance [of] bail. Certainly, when he comes to New York, I can assure you a judge is not going to set bail. So, that could be one of the reasons he’s fighting extradition,” she continued.
It’s unclear when Mangione may face a New York judge. Though on Friday, Manhattan District Attorney Alvin Bragg said that could be sooner than expected.
“Indications are that the defendant may waive, but that waiver is not complete until a court proceeding,” Bragg said.
There has been no official word from Mangione’s Pennsylvania attorney, Thomas Dickey.
Last week, Dickey said they planned to fight extradition.
As the legal defense takes shape, it’s unclear who is paying for Mangione’s counsel. Dickey has refused to comment on whether Mangione’s wealthy family is footing the bill.
“It seems that there’s a certain appetite for him. I don’t get it,” said President-elect Donald Trump on Monday.
Trump and Mayor Eric Adams condemned the support Mangione has received from the public.
As of Monday, supporters have raised more than $130,000 for his legal defense fund.
“No matter how angry we are, you cannot take a ghost gun, put a silencer on it and shoot them. That’s the bottom line,” Adams said.
Mangione remains in a Pennsylvania prison, and his next court appearance in the state is on Dec. 23.
