Standing outside the Brooklyn Field Office of the Administration for Child Services, the family of Nytavia Ragsdale said they blame the city for the death of her 4-year-old son.

Jahmiek Modlin died Oct. 13 after he was found severely malnourished inside his Harlem apartment, according to officials.

“We’re calling on Attorney General [Letitia] James to do an internal investigation,” Kevin McCall, family advisor, said.

McCall said he spoke over the weekend with Ragsdale, 26, on Rikers Island, where she told him she had sought help from ACS in 2022.

“She was crying for help and no one answered,” McCall said.

He said she explained to them she had been suffering from domestic violence and mental health issues.

“They saw. She told them and within a week’s time, she said the case was closed,” McCall said.

In a statement, ACS said, in part, “We continuously assess our work, including through an in-depth review of this case, so we can identify opportunities to strengthen our policies, practices, and services for NYC children and families.”

“We stand firmly behind Nytavia Ragsdale,” Diana Kerlegrand, her sister, said.

Prosecutors said fresh food was found inside the apartment, but the refrigerator had been turned to the wall, the cabinets secured with child safety locks.

Jahmiek’s three siblings are still at the hospital on a liquid diet, unable to eat solid food.

Neighbors said they rarely, if ever, saw the children. Some said they didn’t even know children lived there.

“The family was not aware of the circumstances within the household,” Kerlegrand said.

According to the family, they saw the children about a week earlier through FaceTime. However, they could not answer when they had last seen the children in person.

The family also added Ragsdale also distanced herself from her family, which played a part in not knowing the severity of the situation.

Ragsdale and the child's father, 25-year-old Laron Modlin, have been indicted, according to officials. The indictment will remain sealed until they appear in court.
