An upstate judge has ruled that state cannabis regulators did not have the authority to conduct raids of licensed hemp stores without warrants, and the raids violated store owners' constitutional rights.
The lawsuit was initially brought by a licensed hemp business against the City Sheriff's Office.
Fatima Afia of the Rudick Law Group, which specializes in the cannabis industry, sat down with political reporter Bobby Cuza on “Inside City Hall” Tuesday to talk more about the ruling.
“What the court is saying here is that [Office of Cannabis Management] and the Sheriff’s Office have been conducting these seizures and these searches in ways that have completely violated petitioner’s Fourth Amendment rights to be protected against warrantless seizures and searches,” Afia said.
