Off-Duty Cop Fatally Strikes Pedestrian In The Bronx

An off-duty New York City Police Department detective awaited arraignment Friday, after police said he allegedly struck and killed a pedestrian in the Bronx while driving drunk that morning.

According to police, NYPD Detective Kevin Spellman, 42, was driving a 2009 Chevy south on Kingsbridge Avenue at West 232th Street at around 6:30 a.m. Friday when he hit a woman.

Drana Nikac, 67, seen above, who was pushing a shopping cart full of cans, was transported to Saint Barnabas Hospital where she was pronounced dead.

As of late Friday, charges against Spellman were pending, but police say Spellman will likely be charged with vehicular manslaughter and DWI.

Police say responding officers believed Spellman was drunk, but he refused a breathalyzer both on the scene and at the police precinct. The district attorney issued a warrant for the test and it was administered about five-and-a-half hours after the incident.

Police expect the bloodwork to come back by early next week.

Police say Spellman is a 22-year veteran who worked on the Bronx fugitive task force and had gotten off work a little more than six-and-a-half hours before the crash.

Nikac was an Albanian immigrant from Montenegro, the mother of three and the grandmother of nine, and could be frequently seen collecting cans and recyclables in the street.

Family members mourned Nikac's death from her apartment on nearby Irwin Avenue. One relative said he was stunned when he found out the person accused of killing her is a policeman.

"They are the ones that check us not to drink and drive and happened from them and it's really scary," said Vasel Juncaj, Nikac's nephew.

"We are shocked now," said Rrok Juncaj, Nikac's nephew.

Locals were also saddened with loss.

"I can't believe this. It's just shocking," said a Kingsbridge resident. "She was just a kind woman. Never bothered anyone. Just went about her business collecting cans, trying to make a living for herself. Everybody knew her. The people at [the restaurant] IHOP knew her."

"It could have happened to my child," said another. "It could have been a person crossing the street with a baby carriage."

This is the second time in recent weeks a city police officer has been accused of hitting and killing a pedestrian while driving drunk.

Andrew Kelly faces similar charges for killing Vionique Valnord-Kassime last month in Brooklyn.

An internal NYPD investigation continues into whether police officers who responded to Kelly's accident tried to cover up what happened.

Kelly also refused a breathalyzer but it took seven hours before his blood was drawn.
