Queens Day Care Provider Allegedly Slept Through Toddler's Death

A Queens woman facing child endangerment charges was allegedly sleeping when a toddler in her care drowned in a bucket of water at the day care center she ran inside her home.
Krystal Khan, 28, was arrested Monday. The Queens district attorney's office says that Khan took NyQuil medicine earlier in the morning and fell asleep on the couch, leaving 11-month-old James Daniel Farrior unattended at the day care center Khan ran inside her home.
Khan woke up to find Farrior's body submerged in a bucket of water that was left in the kitchen from the night before.
It is unclear whether the child drowned or broke his neck.
An autopsy was conducted on Farrior but the results are pending further study.
A sign on the window of Khan's home on 108th Street in Ozone Park advertised "Day Care - All Day, Every Day."
The New York City Department of Health says Khan did not have a license to operate a day care facility, but that it may have been an informal care arrangement with less than three unrelated children, which does not require a license.
More than a dozen people, including Farrior's grandmother, showed up for Khan's arraignment Tuesday night.
"It was hard for me to see her because she just came in and looked around like, so nonchalant," said Teresa Weeks, Farrior's grandmother.
Khan's lawyer, Eugene Guarino, says his first order of business is addressing the police questioning.
"The way the statement's were taken, there's going to be issues with it, key issue. A judge is going to have to decide," said Guarino.
"It's a senseless tragedy. Give over a child for the purpose of work, you expect that a child will be taken care of and unfortunately something like this occurs," said Queens District Attorney Richard Brown.
Khan is currently being held on $5,000 bail.
